Terms of Service

These terms govern your use of BizMyte. By creating an account or using the Service, you agree to them.

The Service is provided by GoTech Solutions Pty Ltd (ABN 65 644 150 943), Sydney NSW (“we”, “us”, “our”). “You” means the broker, firm or staff member using the Service.

1. The Service

BizMyte is a software platform that assists Australian mortgage and finance brokers with client management, document review, meeting capture and compliance record-keeping. It is a tool that supports your workflow.

Important — not advice. BizMyte assists with compliance workflows but does not provide legal, financial or compliance advice, and its outputs are aids rather than determinations. You remain solely responsible for meeting your obligations, including under the National Consumer Credit Protection Act 2009 (Cth), ASIC requirements, the Best Interests Duty, and your licensee’s policies. You are responsible for reviewing and verifying any output before relying on it.

2. Eligibility and accounts

The Service is for licensed or authorised brokers and their authorised staff. You must provide accurate information, keep your credentials secure, and you are responsible for activity under your account.

3. Acceptable use

You agree not to misuse the Service, including by using it unlawfully, attempting to breach or test its security without authorisation, interfering with its operation, or using it to infringe the rights of others.

4. Your data and ownership

You retain ownership of the data you and your clients input. You grant us a limited licence to host and process that data solely to provide and improve the Service. You are responsible for having the necessary rights and consents to provide that data to us.

5. Confidentiality

Each party will protect the other’s confidential information and use it only as needed to perform under these terms.

6. Availability

We aim to provide a reliable Service but, during this phase, it is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free.

7. Fees

Where fees apply, they will be as agreed with you. Any applicable fees, billing and trial terms will be made clear before they take effect.

8. Intellectual property

We and our licensors own all intellectual property rights in the Service, excluding your data. No rights are granted to you except as expressly set out in these terms.

9. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot be lawfully excluded. Where permitted, our liability for breach of a non-excludable guarantee is limited to re-supplying the Service or paying the cost of re-supply.

10. Limitation of liability

To the maximum extent permitted by law, and subject to the section above, neither party is liable for indirect or consequential loss, and our total liability arising from the Service is limited to the fees paid by you for the Service in the 12 months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify us against claims arising from your unlawful use of the Service or your breach of these terms, to the extent permitted by law.

12. Term and termination

Either party may terminate in accordance with any plan terms or on reasonable notice. On termination, your right to use the Service ends; we will make your data available for export for a reasonable period, subject to legal requirements.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.

14. Changes

We may update these terms from time to time. Material changes will be notified, and the “Last updated” date reflects the current version.
